By accessing the Website or making a purchase, you agree to be bound by these Terms. Please read them carefully before completing any transaction.

1. Original Artwork Sales & Refund Policy

  • Final Sale: All sales of original paintings are final and non-refundable. Due to the unique, delicate, and irreproducible nature of original artwork, we cannot accept returns or offer refunds once a purchase is completed.

  • Issue Resolution: The artist endeavors to assist in solving any problems or concerns that may arise after your purchase (such as transit issues or minor concerns). However, please note that the artist may not be able to offer a refund under any circumstances.

  • Prints and Merchandise: Prints and merchandise may be exchanged within 14 days if damaged upon arrival."

2. Shipping, Delivery, and Separate Invoicing

  • Shipping Cost Estimates: Shipping costs calculated at checkout are estimates only and are subject to change based on the destination, packaging requirements, and insurance for high-value original artwork.

  • Separate Invoicing for Shipping:Shipping costs for original paintings may be invoiced separately. If separate invoicing is required, the artist will contact you post-purchase with a precise shipping quote. The artwork will not be dispatched until the shipping invoice is paid in full.

  • Import Duties and Taxes: For international orders, the buyer is solely responsible for any customs duties, import taxes, or brokerage fees levied by the destination country.

  • Damaged Shipments: In the rare event that an artwork arrives damaged, you must contact us within 3 days of delivery with photographic evidence of both the packaging and the damage to the artwork so we can assist in filing an insurance claim with the carrier.

3. Intellectual Property & Copyright

  • Retention of Rights: The artist retains all intellectual property rights, including all copyrights, to the artwork created, even after the physical painting is sold.

  • Prohibited Use: The purchase of an original painting or print does not transfer any reproduction rights to the buyer. You may not reproduce, scan, copy, resell prints of, or commercially exploit the artwork in any digital or physical form without prior express written consent from the artist.

4. Product Descriptions and Color Accuracy

  • Visual Representation: We make every effort to display the colors, textures, and details of the artwork as accurately as possible on the Website.

  • Screen Variations: However, because computer monitors and mobile screens display colors differently, we cannot guarantee that your device's display of any color will be 100% accurate to the physical painting. Minor variations in color or texture are inherent to original art and do not constitute a defect.

5. Pricing and Payment

  • Payment Terms: All prices are listed in GBP (British Pound) and are subject to change without notice. Payment must be received in full via our approved payment gateways before an order is processed.

  • Right of Refusal: We reserve the right to refuse or cancel any order if we suspect fraud, an unauthorized or illegal transaction, or an obvious pricing error on the Website.

6. Limitation of Liability

  • To the maximum extent permitted by law, Lucy Muss shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of the Website, the handling or display of the artwork, or the inability to fulfil a delivery due to circumstances beyond our reasonable control (usually a Force Majeure).

7. Governing Law

  • These Terms and your use of this Website shall be governed by and construed in accordance with the laws of United Kingdom without regard to its conflict of law principles.
